Acceptable Use Policy

This Acceptable Use Policy ("AUP") defines the permitted and prohibited uses of the WpAsis platform operated by Web Engine Dijital.

1. Purpose

WpAsis is designed to help businesses automate legitimate customer communication through WhatsApp. This policy ensures the platform is used responsibly, ethically, and in compliance with applicable laws and WhatsApp's own terms.

2. Permitted Use

You may use WpAsis for:

Legitimate business communication with your customers.
Customer support and inquiry handling.
Appointment booking and scheduling.
Product and service inquiries.
Order updates and notifications to customers who have opted in.

3. Prohibited Activities

The following activities are strictly prohibited:

Spam: Sending bulk unsolicited messages to contacts who have not opted in.
Misleading content: Sending deceptive, fraudulent, or impersonating messages.
Phishing: Attempting to obtain sensitive information through deceptive means.
Harassment: Using the service to threaten, bully, or harass individuals.
Illegal activities: Using the service for any purpose that violates applicable laws.
Circumventing WhatsApp limits: Attempting to bypass rate limits, bans, or restrictions imposed by WhatsApp/Meta.
Reselling access: Sharing, sublicensing, or reselling your WpAsis account or API access to third parties.
Scraping: Using the service to extract, scrape, or harvest data from WhatsApp or other platforms.

4. Identity Disclosure & Hidden Mode

WpAsis offers an optional Hidden Mode (a.k.a. identity disclosure mode = hidden) that allows the AI assistant to respond as if it were the user personally, without disclosing that it is an AI. By enabling this mode, you acknowledge and accept the following:

Full legal responsibility: All legal, regulatory, and ethical consequences arising from the use of Hidden Mode rest solely and entirely with you, the user who enabled it. WpAsis provides the technical capability but does not endorse any particular use case.
Regulatory compliance: Certain jurisdictions (including but not limited to the EU AI Act 2025, consumer protection laws, and unfair commercial practices regulations) may restrict or prohibit non-disclosure of AI involvement in automated conversations. You are responsible for ensuring that your usage complies with all applicable laws in every jurisdiction where your conversation partners reside.
Consent-based use only: Hidden Mode must never be used to deceive, defraud, manipulate, or cause harm to the other party. It is intended for personal-use scenarios where disclosure is not legally required and where the conversation partner would reasonably expect direct human communication.
Platform enforcement: If WpAsis detects or is notified of abuse of Hidden Mode (including but not limited to fraud, impersonation of others, harassment, or violation of applicable laws), we reserve the right to suspend or permanently terminate the account without refund, in addition to cooperating with law enforcement where required.
One-time acknowledgement: The first time Hidden Mode is enabled, you must explicitly acknowledge these terms via an in-product confirmation dialog. The timestamp of this acknowledgement is recorded and may be produced as evidence of informed consent.

5. WhatsApp Compliance

Users must comply with the WhatsApp/Meta Terms of Service at all times. WpAsis is not responsible for account restrictions, bans, or other actions imposed by Meta/WhatsApp as a result of your usage patterns. It is your responsibility to ensure your messages comply with WhatsApp's policies.

6. Enforcement

Violations of this policy are handled progressively:

Warning: First violation results in a written warning via email.
Suspension: Repeated or serious violations result in temporary account suspension.
Termination: Continued violations or a single egregious violation result in permanent account termination without refund.

7. Reporting Violations

If you become aware of any misuse of the WpAsis platform, please report it to info@wpasis.com. We investigate all reports and take appropriate action.
